Wir verarbeiten personenbezogene Daten nur, soweit dies gesetzlich zulässig ist und insbesondere die Bestimmungen der Verordnung (EU) 2016/679 (Datenschutz-Grundverordnung – DSGVO) sowie die jeweils anwendbaren nationalen Datenschutzvorschriften eingehalten werden.

Die Verarbeitung personenbezogener Daten erfolgt insbesondere zu folgenden Zwecken:

  • zur Bereitstellung und zum sicheren Betrieb unserer Website;

  • zur Bearbeitung von Anfragen;

  • zur Bearbeitung von Anfragen bezüglich eines Aufenthalts auf unserem Bauernhof;

3. Besuch unserer Website und Server-Logdaten

Beim Aufruf unserer Website werden durch den verwendeten Browser und die technische Infrastruktur automatisch bestimmte technische Informationen übermittelt.

Die Verarbeitung dieser Daten erfolgt insbesondere, um unsere Website technisch bereitzustellen, ihre Funktionsfähigkeit, Stabilität und Sicherheit zu gewährleisten sowie Missbrauch und technische Angriffe erkennen und verhindern zu können.

Rechtsgrundlage: Art. 6 Abs. 1 lit. f DSGVO. Unser berechtigtes Interesse liegt in der sicheren und technisch ordnungsgemäßen Bereitstellung unserer Website sowie in der Abwehr von Missbrauch und Cyberangriffen.

Speicherdauer: Wir speichern Server-Logdaten in der Regel für bis zu 90 Tage. 4. Hosting unserer Website durch Wix

Unsere Website wird mit dem Website-Baukasten und den technischen Diensten von Wix.com Ltd. betrieben.

5. Kontaktaufnahme per E-Mail oder Telefon

Wenn Sie uns per E-Mail oder telefonisch kontaktieren, verarbeiten wir die von Ihnen mitgeteilten personenbezogenen Daten.

Die Verarbeitung erfolgt zur Bearbeitung Ihrer Anfrage und zur Kommunikation mit Ihnen.

Rechtsgrundlage:

  • Art. 6 Abs. 1 lit. b DSGVO, soweit die Anfrage auf den Abschluss eines Beherbergungsvertrags gerichtet ist oder der Verarbeitung zur Durchführung vorvertraglicher Maßnahmen dient;

  • Art. 6 Abs. 1 lit. f DSGVO, soweit es sich um eine allgemeine Anfrage handelt und die Verarbeitung zur Beantwortung dieser Anfrage erforderlich ist. Unser berechtigtes Interesse besteht in der Beantwortung Ihrer Anfrage;

  • Art. 6 Abs. 1 lit. c DSGVO, soweit wir gesetzlich zur Verarbeitung verpflichtet sind (insbesondere zur Meldung an die Questura gemäß italienischem Sicherheitsgesetz bei späterer Buchung).

Speicherdauer: Wir speichern die Daten grundsätzlich nur so lange, wie dies zur Bearbeitung der Anfrage erforderlich ist. Nicht zu einer Buchung führende Anfragen werden grundsätzlich innerhalb von 12 Monaten gelöscht, sofern keine gesetzlichen oder berechtigten Gründe für eine längere Speicherung bestehen.

Kommt aufgrund der Anfrage ein Beherbergungsvertrag zustande, gelten für die betreffenden Daten die entsprechenden gesetzlichen Aufbewahrungsfristen (insbesondere 10 Jahre gemäß steuerrechtlichen Vorschriften).

6. Anfrageformular für einen Aufenthalt

Auf unserer Website bieten wir Ihnen die Möglichkeit, online eine unverbindliche Anfrage für einen Aufenthalt auf unserem Bauernhof zu stellen.

Bei Nutzung des Anfrageformulars werden folgende Angaben abgefragt:

  • Name;

  • E-Mail-Adresse;

  • Telefonnummer;

  • gewünschter Anreisetermin;

  • gewünschter Abreisetermin;

  • Anzahl der Personen;

  • Notiz bzw. Nachricht.

Die von Ihnen eingegebenen Daten werden benötigt, um Ihre Anfrage zu bearbeiten, die gewünschte Verfügbarkeit zu prüfen und mit Ihnen bezüglich Ihres Aufenthalts Kontakt aufzunehmen.

Die Verarbeitung erfolgt insbesondere zur Durchführung vorvertraglicher Maßnahmen auf Ihre Anfrage hin bzw. zur Vorbereitung eines möglichen Beherbergungsvertrags.

Rechtsgrundlage: Art. 6 Abs. 1 lit. b DSGVO.

Soweit eine Anfrage keinen unmittelbaren Bezug zu einem möglichen Vertragsabschluss hat, kann die Verarbeitung auch auf Art. 6 Abs. 1 lit. f DSGVO beruhen. Unser berechtigtes Interesse besteht in der Bearbeitung und Beantwortung von Anfragen von Interessenten.

Die Angabe der für die Bearbeitung der Anfrage erforderlichen Daten ist freiwillig. Ohne diese Angaben können wir Ihre Anfrage unter Umständen nicht oder nicht vollständig bearbeiten.

Die von Ihnen übermittelten Daten werden nicht für andere Zwecke verwendet, sofern keine gesetzliche Grundlage hierfür besteht oder Sie in eine entsprechende Verarbeitung eingewilligt haben.

7. Verarbeitung des Anfrageformulars über Wix

Das Anfrageformular wird über Funktionen von Wix bereitgestellt.

Wenn Sie das Anfrageformular ausfüllen und absenden, werden die von Ihnen eingegebenen Daten über die technische Infrastruktur von Wix verarbeitet und an uns übermittelt.

Hierzu gehören insbesondere:

  • Name;

  • E-Mail-Adresse;

  • Telefonnummer;

  • Anreise;

  • Abreise;

  • Anzahl der Personen;

  • Ihre Nachricht bzw. Notiz.

Die Daten können innerhalb der von Wix bereitgestellten Systeme gespeichert und verarbeitet werden, damit wir Ihre Anfrage erhalten, verwalten und beantworten können.

Wir haben mit Wix eine Vereinbarung zur Auftragsverarbeitung gemäß Art. 28 DSGVO abgeschlossen.

8. Kommunikation nach einer Anfrage

Wenn Sie uns über das Anfrageformular kontaktieren, können wir Ihre angegebenen Kontaktdaten verwenden, um Ihre Anfrage zu beantworten.

Die Kommunikation kann insbesondere per:

  • E-Mail;

  • Telefon;

  • WhatsApp (falls zutreffend)

erfolgen.

Die Kommunikation dient ausschließlich der Bearbeitung Ihrer Anfrage und gegebenenfalls der Vorbereitung bzw. Durchführung eines Aufenthalts.

Eine Verwendung der Kontaktdaten für allgemeine Werbung erfolgt nicht, sofern hierfür keine entsprechende Rechtsgrundlage besteht oder Sie hierfür eine gesonderte Einwilligung erteilt haben.

9. Speicherung und Löschung personenbezogener Daten

Wir speichern personenbezogene Daten grundsätzlich nur so lange, wie dies für den jeweiligen Verarbeitungszweck erforderlich ist.

Für Anfragen, die nicht zu einer Buchung oder einem Vertragsverhältnis führen, werden die Daten gelöscht, sobald die Anfrage abschließend bearbeitet wurde und keine berechtigten Gründe für eine weitere Speicherung bestehen. In der Regel erfolgt die Löschung innerhalb von 12 Monaten nach Abschluss der Bearbeitung.

Kommt aufgrund einer Anfrage ein Beherbergungsvertrag zustande, werden die hierfür erforderlichen personenbezogenen Daten für die Durchführung des Vertrags und anschließend entsprechend den gesetzlichen Aufbewahrungsfristen gespeichert.

Gesetzliche Aufbewahrungspflichten:

  • Steuerrechtliche Vorschriften: 10 Jahre (Rechnungen, Buchungsbelege)

  • Handelsrechtliche Vorschriften: 10 Jahre (Geschäftsbriefe, Verträge)

  • Alloggiati Web (Questura): Die Empfangsbestätigung der Gästemeldung wird für 5 Jahre gespeichert. Nach erfolgter Meldung werden keine Kopien der Ausweisdokumente gespeichert.

Darüber hinaus können Daten gespeichert werden, wenn dies zur Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen erforderlich ist.

Nach Ablauf der jeweiligen Speicherfrist werden die personenbezogenen Daten gelöscht, sofern keine gesetzliche Verpflichtung oder ein sonstiger rechtlich zulässiger Grund für eine weitere Speicherung besteht.

10. Weitergabe personenbezogener Daten

Wir geben personenbezogene Daten grundsätzlich nur weiter, wenn dies zur Erfüllung der genannten Zwecke erforderlich und datenschutzrechtlich zulässig ist.

Empfänger personenbezogener Daten können insbesondere sein:

  • Wix bzw. von Wix eingesetzte technische Dienstleister;

  • IT- und Hosting-Dienstleister;

  • E-Mail- und Kommunikationsdienstleister;

  • Steuerberater und sonstige berufliche Berater;

  • Behörden und öffentliche Stellen, soweit wir gesetzlich hierzu verpflichtet sind (insbesondere Meldung der Gästedaten an die Questura über das Portal „Alloggiati Web" gemäß italienischem Sicherheitsgesetz);

  • Rechtsanwälte und sonstige Berater, soweit dies zur Wahrung unserer Rechte erforderlich ist;

  • Zahlungsdienstleister (falls künftig Online-Zahlungen angeboten werden);

  • weitere Dienstleister (falls erforderlich).

Eine Weitergabe personenbezogener Daten zu Werbezwecken erfolgt nur, wenn hierfür eine entsprechende Rechtsgrundlage besteht.

11. Auftragsverarbeitung

Soweit wir externe Dienstleister mit der Verarbeitung personenbezogener Daten beauftragen und die gesetzlichen Voraussetzungen einer Auftragsverarbeitung vorliegen, erfolgt die Verarbeitung auf Grundlage einer Vereinbarung gemäß Art. 28 DSGVO.

Die eingesetzten Dienstleister dürfen personenbezogene Daten grundsätzlich nur entsprechend den vereinbarten Zwecken und den geltenden datenschutzrechtlichen Vorgaben verarbeiten.

12. Übermittlung personenbezogener Daten in Drittländer

Bei der Nutzung bestimmter technischer Dienste kann es dazu kommen, dass personenbezogene Daten außerhalb des Europäischen Wirtschaftsraums (EWR) verarbeitet werden.

Eine Übermittlung in Drittländer erfolgt nur, wenn die Voraussetzungen der Art. 44 ff. DSGVO erfüllt sind.

Hierzu können insbesondere gehören:

  • ein Angemessenheitsbeschluss der Europäischen Kommission;

  • Standarddatenschutzklauseln der Europäischen Kommission;

  • andere gesetzlich anerkannte geeignete Garantien.

Google Maps wird auf unserer Website erst nach Ihrer vorherigen Einwilligung über das Cookie-Banner geladen. Die Karte wird initial nicht automatisch angezeigt, sondern nur, wenn Sie aktiv zustimmen.

Durata di conservazione: conserviamo i dati, in linea di principio, solo per il tempo necessario alla gestione della richiesta. Le richieste che non portano a una prenotazione vengono generalmente cancellate entro 12 mesi, salvo che sussistano motivi legali o legittimi per una conservazione più lunga.

Qualora dalla richiesta derivi un contratto di soggiorno, per i relativi dati si applicano i corrispondenti termini di conservazione previsti dalla legge, in particolare il termine di 10 anni previsto dalla normativa fiscale.

6. Modulo di richiesta per un soggiorno

Sul nostro sito web vi offriamo la possibilità di inviare una richiesta non vincolante online per un soggiorno presso il nostro maso.

9. Conservazione e cancellazione dei dati personali

Conserviamo i dati personali, in linea di principio, solo per il tempo necessario alla rispettiva finalità del trattamento.

Per le richieste che non portano a una prenotazione o a un rapporto contrattuale, i dati vengono cancellati non appena la richiesta è stata definitivamente gestita e non sussistono motivi legittimi per un'ulteriore conservazione. Di norma, la cancellazione avviene entro 12 mesi dalla conclusione della gestione della richiesta.

Qualora dalla richiesta derivi un contratto di soggiorno, i dati personali necessari vengono conservati per l'esecuzione del contratto e successivamente in conformità ai termini di conservazione previsti dalla legge.

Obblighi di conservazione previsti dalla legge:

  • normativa fiscale: 10 anni (fatture, documenti contabili relativi alle prenotazioni);

  • normativa commerciale: 10 anni (corrispondenza commerciale, contratti);

  • Alloggiati Web (Questura): la ricevuta della comunicazione degli ospiti viene conservata per 5 anni. Dopo l'avvenuta comunicazione non vengono conservate copie dei documenti di identità.

Inoltre, i dati possono essere conservati qualora ciò sia necessario per far valere, esercitare o difendere diritti legali.

Al termine del rispettivo periodo di conservazione, i dati personali vengono cancellati, salvo che sussista un obbligo di legge o un altro motivo legalmente ammesso che ne giustifichi l'ulteriore conservazione.

10. Comunicazione dei dati personali a terzi

Comunichiamo i dati personali, in linea di principio, solo qualora ciò sia necessario per il perseguimento delle finalità indicate e sia consentito dalla normativa in materia di protezione dei dati.

11. Responsabili del trattamento

Qualora incarichiamo fornitori esterni di servizi del trattamento di dati personali e sussistano i presupposti di legge per un trattamento per conto del titolare, il trattamento avviene sulla base di un accordo ai sensi dell'art. 28 GDPR.

I fornitori di servizi incaricati possono trattare i dati personali, in linea di principio, solo in conformità alle finalità concordate e alle disposizioni applicabili in materia di protezione dei dati.
